Definitions

In these Purchaser Terms and Conditions, the following words are defined and have a specific meaning:

· 'Merchant' means any participating retail store, hospitality provider or other service provider that we act as agent for and that is listed on this website;

· 'Merchant Goods' means any merchandise offered for sale by a Merchant;

· 'Merchant Services' means any services that are offered for sale by a Merchant;

· 'the Rain Check’ and ‘Rain Check’ mean the voucher or vouchers supplied by us, for use by you, to redeem for Merchant Goods and/or Merchant Services;

· ‘We', 'us' and 'our' are a reference to Mackbron Pty Limited trading as Local Rain Check;

· 'You' and 'your' are a reference to you as the Purchaser;

· ‘Your Local Merchant’ means the Merchant that you have chosen to purchase a Rain Check from.

Operation of Local Rain Check

1. This service has been set up to help Merchants during the period of the Covid-19 virus. The purpose of the website is to help Merchants sell Rain Checks, which can be redeemed in the future for any Merchant Goods and/or Merchant Services they ordinarily sell.

2. We act as an agent for the Merchants and provide a not-for-profit service to them. We issue Rain Checks on behalf of the Merchants and collect payment from the Purchaser to remit to the Merchant. All funds, less any applicable transaction fees, are passed on to the Merchant as soon as the funds have cleared.

3. By purchasing a Rain Check, you enter into a contract with Your Local Merchant. We act as an agent to facilitate the processing of payment and issuance of the Rain Check voucher only.

4. Your Local Merchant is the seller of the Rain Check and is solely responsible for providing any Merchant Goods and/or Merchant Services that you choose to redeem your Rain Check for. Any communications in relation to the redemption of your Rain Check must occur directly with Your Local Merchant.

Purchase of Local Rain Checks

1. Rain Checks are only redeemable for Merchant Goods and/or Merchant Services as ordinarily available from Your Local Merchant and will be subject to such terms and conditions as Your Local Merchant may usually or reasonably apply to the provision of such Goods and Services. The redemption of the Rain Check for alcohol is at the discretion of Your Local Merchant.

2. Each Rain Check includes a unique code and may only be redeemed for the value purchased. If the Rain Check is redeemed for Merchant Goods and/or Merchant Services having a lesser retail value, then the remaining balance of the Rain Check will only be redeemable directly via Your Local Merchant. Rain Checks cannot be redeemed for cash or cash equivalents and are non-refundable.

3. Rain Checks cannot be combined with any other offers, vouchers or promotions, unless otherwise specified by Your Local Merchant. Once a purchase has been made, no refunds or exchanges will be given except where required by law. Any refund or exchange required by law will be the responsibility of Your Local Merchant and cannot be claimed against us.

4. Rain Checks are valid for three (3) years from date of purchase.

5. If a Merchant decides to stop advertising via this website that Merchant will still be obligated by law to honour any Rain Checks already purchased subject to these Purchaser Terms and Conditions.
